Now you are mixing up deed of trust and deed (what is a title deed?)- these are NOT interchangeable items and how you can assign these to different people. I am sorry and I am not going to correct this again or respond to any more of this because it is going nowhere. I am not a mortgage broker. Being a lender myself, I will only tell you again that you are incorrect with the 12 payments - I have no idea where this comes from. Since it is all not that straightforward as you claim, Bubzeebub192 should suggest the taxpayer to get legal counsel. Potentially large amounts of money are at stake and I have seen a lot of stupidity out there and people losing it all. The title company can usually also be very helpful to in giving guidance.

The IRS, and other tax professionals, have also said that the tax nor the interest are deductible. I've suggested the taxpayer contact the attorney who is handling the case. I will reply back and let you all know what the outcome is.
