I heard something about a "loophole" for Nasba states, and I think CA is not a Nasba state, so if I am waiting for my final result (Audit took it early Nov, Wave1?), can I try to Reapply to the state & if they deny my application, it means I passed? (Where if they accept it, means i failed).

The loophole does work, but only for Nasba states. So, if California is not a nasba state, then it won't work. And it only works when the AICPA releases the grades to Nasba, which won't be for a few more weeks. The loophole only lets you know about 24-48 hours before you get your score on the nasba website.
